Q: Do you think that the US Supreme Court (or any sensible US court) would rule in favor of resticting the US Constitution's "Freedom of the Press" rights, in favor of the Digital Millennium Copyright Act? Does the power of the DMCA superceed the Constitution?

Yes - It has been often told that there is something in the United States called the "Freedom of the Press"... and it has quite a respectable history!

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Story: There was once a leaking of information to some Washington Post reporters that lead to something called "Watergate" and to this day we don't now the identity of the "deep throat" source. I think that someone by the name of NIXON lost his job as President as a result of "freedom of the Press". We need to keep in mind that the Post reporters had to be 100% certain that what they were being told was fact and not fiction!

So - In order to directly confront the current state of fear that is evidenced by this, an other, article(s) about restricions to the free flow of information [caused by the Digital Millennium Copyright Act (DMCA)] then maybe, security researchers (and others who are responsible minded security individuals), after legal council, should look toward building and establishing working relationships with respected member(s) of the digital security press (at least for now until any pending case is settled that will establish more boundries to the DMCA).

The use of respected members of the press by 100% respectable members of the security researchers be a legal channel to facilitate that release of security related information is at least timely.

Why even responsible and guilt ridden Microsoft employees, who know something about a MS secrurity problem, could also establish such a press contact to confess to. AND such an employee, or employees, may ALSO be protected by "Whistle Blower types of laws"? AND can you imagine that such an employee may be able to make money by doing such an honest "whistle blowing" deed?

Hmmm, If the emporer is wearing no cloths... than, it is best that this information is not overlooked... and that the emporer knows that this situation exists (sooner rather than later)! AND if the emporer should choose to continue to wear no cloths... then, the rest of us should be forewarned and and have a mechanism in place permits us the CHOICE to act accordingly.

In order for security minded software users, citizens of the US (and the whole world) to be able to make informed choices, we need to be properly informed. Sooner, rather than later!
