We know that technology can be used to track people's location via a cellphone, but how difficult is it for law enforcement to get a court order and do this legally?

You are, of course, correct. The Fourth Amendment is terribly inconvenient, and should be repealed. Indeed, many more people are killed each year from drug dealing or ordinary crime than by terrorism, so we should suspend the Fourth Amendment for all crimes..oh, and the Fifth Amendment too.. we would solve a LOT more crimes if we didnt have those pesky criminal defense lawyers, and could interrogate people without them without them refusing to talk. Indeed, society would be much safer.. well, safer from everybody except the government itself.

Why would it be so terrible to have the executive branch go to the courts for approval of invasions of privacy? If they cannot convince the COURTS that what they are doing is appropriate, in a hearing that is ex parte and in camera, then maybe.. just maybe.. its not all that reasonable.
