We know that technology can be used to track people's location via a cellphone, but how difficult is it for law enforcement to get a court order and do this legally?

Working in IT, we (the company I work at) have a policy not to snoop on users' desktops without their consent, though we can review log files and stored content at any time. Want to see what they're doing as they are browsing the web? No problem - I can quite legitimely view their internet cache in real-time, as it is stored content. I thoroughly expect *some* mobile communications services have data buffering/caching, and can only expect this to increase.
How long does data have to remain static for, before the user is protected by law and the police/agencies require an extra step of authorisation before snooping is allowed?
