We know that technology can be used to track people's location via a cellphone, but how difficult is it for law enforcement to get a court order and do this legally?

when you dial 911 on a modern cell phone it activates the gps unit, and i assume it sends your coordinates along with the call.
i think the issue is when the gps is activated without an emergency call being made, or without user being aware.
