It doesn't seem that copyright law prohibits the conduct that Mr. Kopp engaged in. If the EULA is extended to do so, then it becomes the contract, rather than the law, that has been violated.
That assumes Blizzard's EULA was in fact violated and is on-face valid and enforceable...
