Retain or restrain access logs?

A recent proposal by the U.S. Department of Justice that would mandate Internet Service Providers to retain certain records represents a dangerous trend of turning private companies into proxies for law enforcement or intelligence agencies against the interests of their clients or customers.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

There are no limitations to this in the Constitution and no law is valid that would abridge constitutionally protected rights. Ther is no clause in there that I can see that gives the government more rights if they can attack my expectation of privacy. There is nothing in there that discusses the motive or purpose of the search. There is no out clause for national security. Indeed it can be said that the National security interest is served by preventing the government from violating this. There is also no mention of prosecution. It is the act of gathering the information that violates my rights.

Furthermore it has been understood that the 4th ammendment is not intended to protect a specific place (your house) but rather people. This includes all the myriad things that people do and all the digital or other records that they leave behind them as they go about their lives.

The government is clearly in the wrong here and should be taken to task for violating our rights.
