A recent lawsuit filed against Microsoft should have all companies reexamining their privacy policies to determine what information they are actually collecting about customers, and what they can possibly do with it.

The bottom line is this: Microsoft has a right to protect its intellectual property interests. They develop and support the code. If you don't like it, then use something else. That's YOUR right. Believing that there are different kinds of theft is a character flaw, and if you steal Microsoft's code "because they are the big bullys on the block and they have all the money", then it's theft. If you don't like their licensing, then use something else. Might I suggest www.distrowatch.org? I'll personally keep plugging away using my licensed and fully functional copy of Windows. If you're really that worried about Microsoft having a few details about you, then you really, really have a limited scope of what's out there in the way of information about you.
