To a phone CO technician, looking at an analog signal travelling through a switch to troubleshoot it doesn't mean that said tech can actually know the exact verbal contents of a given phone call. Email is a bit different, in that you can see exactly what's in a given mail just by opening the queue (unless its encrypted, but most aren't).
I have a sinking feeling that the idea of equating email to phone conversations may have been an easy idea law-wise, but that it's going to really wreck things as time goes on.
