Even with a well-heeled corporate privacy policy stating that all employee communications may be monitored in the workplace, the legality of e-mail monitoring is not as clear cut as one might think.

Okay, so how does the email admin (and by extension, backup/Disaster Recovery) fit into this? After all, email is routinely backed-up, troubleshooting a balky SMTP server sometimes means looking into the contents of an active mail queue to see/prove mangled email (so you know if a problem stems locally or remotely), etc...

To a phone CO technician, looking at an analog signal travelling through a switch to troubleshoot it doesn't mean that said tech can actually know the exact verbal contents of a given phone call. Email is a bit different, in that you can see exactly what's in a given mail just by opening the queue (unless its encrypted, but most aren't).

I have a sinking feeling that the idea of equating email to phone conversations may have been an easy idea law-wise, but that it's going to really wreck things as time goes on.
