The problem is not the ordinary terms of the EULA -- you know, that you agree to jurisdiction in Washington State, or that there are no warranties, or even a limitation on damages. The problem here is that MS has given itself the right to determine unilaterally and unequivically whether you have breached the terms of the EULA and then to take action against you for what it deems is a breach, whether or not there is a true breach. It allows MS but not you, to unilaterally ENFORCE the EULA.
