If such a discovery process is to work, the first requirement would be that the software utilize a two-way handshake of some kind with the stolen wares. Otherwise, simple IP spoofing could be used to justify a discovery-driven fishing expedition into customer records. As the FBI now knows from experience, that's a bad thing to do if you want to save PR face.
