Could a possible solution to this problem be found in the licensing proceduresfor the IP addresses themselves? IP address space is managed by groups like ARIN in the US. Could the terms under which IP address space is allocated be ammended to require certain levels of discovery by those granted IP addresses? That would help to take it out of the realm of the courts (to an extent).
