Mark Rasch, 2007-12-11

On October 1, 2007, Jammie Thomas -- a single mother living in Brainerd, Minnesota -- was sued in civil court for copyright infringement by the Recording Industry Association of America. Three days later, the jury returned the verdict; Ms. Thomas was liable for willfully infringing the copyrights on 24 songs. The fine: $222,000.

I agree with Mark's article but one thing I never see discussed is the fact that Music and Movies are not forever. When sales of a particular work drop below a certain level the work is deleted from the catalog and may be collected and destroyed or sold in the cut out section of some record stores. I have a large collection of CD's which I started collecting in 1984. I wanted to purchase a duplicate Christmas CD that I have in my collection and send it to a friend but learned that the CD in question is no longer available new or used. Now what? If I copy the CD on a CD ROM and send it to my friend I would be violating the copyright. Obviously this would not be easily detected. I would like to know Mark Rasch's opinion on how to protect the consumer to allow the copying of any Copyrighted work that the copyright owner has chosen to remove from commercial distribution and give the copy to a friend at no charge.
