Well kids still can destroy your car by using sugar en putting it into your cars fueltank.
But to get into the legal stuff. I'm sure this could work in the USA, but does/might not work in other countries.
And think you will have quite a difficult case sinds you habe to prove they didnt do enought to protect you agains this.
Another thing: software correctness cant be proven - ots to complex for that. Even if you try to evaluate all possible ways a progam can run, this will takes ages. Therefore I think you cant prove software is safe, even with very advanced techniqees. Yu can prove it has failures, but testing software for known problems, does that implies it has no problems at all?
