Well what about contract law
But don't you have to use Google (i.e. send an HTTP request and get a response) to see their TOS? Isn't there a question of fact authorization has been provided? If you are using a standard protocol (HTTP) in a standard way (i.e. not CMD.exe?../../../) and are not required to click an "I agree" link than there would be a good argument that you are within implied authorization. Forming a contract (by clicking "I agree") could limit the implied authorization.
