Spam is not free speech. Never has been.

Commercial speech has already been ruled, repeatedly, to not be protected by the first amendment, which is why you have so many laws now on the books governing what advertisers can and cannot do.

With spam, it's "postage due" email, where the recipient bears the cost of the email, not the spammer. THIS is why the courts are coming down so hard on spammers now. It's not WHAT the spammer is saying, it's HOW they're saying it that's getting them in trouble, and rightly so.

Please go back to first year law school. It's clear you need a refresher course on constitutional law.
