The Good Samaritan defence, invoked by hackers like Adrian Lamo, can too easily be distorted by those with less altruistic intentions.

That comparison about the bank is not accurate. If that's all that the persons in question were doing, just seeing if the hole is there, then that's fine, and no one is really questioning that. But if the person walked into the open door, then found a bunch of safety deposit boxes that weren't properly sealed, then opened them up and rummaged through their contents, then the guy should go to jail, whether he takes anything or not. He had no right to enter the door, just cause he could. He should tell someone, hey, that door's open, and no one would bat an eyelash, but if he said, hey, the door's open, and i went through the safety deposit boxes in there and found some interesting stuff, then cuff the bastard.
