You have a number of interesting points, but there is one that I take issue with.

Working as I do in insurance, I can tell you that any attempt to legislate insurance programs for losses due to cyber-security exposures will certainly NOT curry favor with the insurance industry. Simply put, if there is a demand for the product, the industry will respond on its own. Having a government agency dictate supply (and demand) of a product is doomed to produce unprofitable results. The industry is currently fighting a number of battles to regain its profitablility (outrageous and unprecidented damage awards, asset management philosophy, terrorism coverage availability, etc). Adding yet another government mandated insurance program is definately not a welcome prospect.
