I do not believe that administrators should have the right to attack other systems without liability for the damage they cause. Realistically, if a system is compromised and begins attacking me.. what are the chances they'll be able to detect my actions?
Attacking another system without knowledge of it's configuration, purpose, or "value" is a dangerous proposition. People should be held liable (criminally and civilly) for the damages they cause.
Personally, I would like to see a more proactive approach by ISP's. I don't know what the final solution shouuld look like or who pays. I have heard of ISP's disconnecting "problem" customers. ISP's should implement and enforce policies like this.. and possibly legislation making the ISP responsible, to some degree, for damage caused by their networks.
