Whatever other evils "Big Business" might be up to, government came up with this one all by themselves. In fact, business HATES this stuff just as much as you do, for two simple reasons:
a) it increases operating costs (a LOT) without generating any revenue; and
b) the NSA is spying on business just as much as it is on private citizens. In fact, NSA is probably much MORE interested in big overseas contracts than in your email to Aunt Mavis.
The EFF would probably get more mileage if, instead of suing the companies forced to do this, they organised an ad hoc, pro tem coalition of both aggrieved businesses and human rights activists to get the laws repealed.
