Not that this is any consolation but every time Blizzard sends down a patch you have to re-Agree with the EULA to be able to play the game. I'm guessing, though I have not verified, that there are some words in there that relate to Warden in some legalese that does not specifically call it out as "You agree to install Warden" but comes to the same thing.

Agree you get to play the game, don't and you don't. So I wouldn't get all jumpy on Blizzard about not informing people that stuff is getting installed. They'd be stupid not to include it in the EULA.
