I agree. This is almost disgusting. This case proves that our legal system still has a long, long way to go in understanding and prosecuting cases involving digital evidence. I hope she can acquire the services of a good, honest computer forensic tech and win an appeal. Then sue the pants off of everyone that was involved.

The bad thing is there is a big push to discourage computer forensic technicians from participating representing the defense in criminal cases. EnCase won't allow you to go to their training, the organization (can't remember what the name is) won't allow you to join, etc etc....

So, in summary, I think this also shows that there is a legitimate cause to allow computer forensic techs to represent the defense in some cases. After all, aren't the accused entitled to a fair trial, too?
