I don't know specifically about Black Hat but normally when someone comes to a conference to teach they are not an employee of the organization sponsoring the conference. They are performing a service. This holds true if they are American or otherwise. So the H1B thing is BS. It is very possible that the customs agent had no idea of how conferences work and assumed that Halvar was here to actually start a job. He should appeal this if possible because it sounds like a misunderstanding.
