IMHO It is almost a political problem. If a creative and skilled programmer goes without a paying job he can always employ himself and earn a living by creating malicious software. If he is caught and can't get another programming because of his conviction, it only pushes him/her harder to not get caught. Not stopping them from creating malicious software.
