Ummm, domestic spying is internal-interal (i.e. you talking to your Aunt Edna in Nebraska); what happened here is spying on internal-external communications to 'foreign powers' (i.e. you talking to your uncle Habib in Syria). Presidents have always had the power to collect intelligence on communications with foreign powers w/o a warrant, especially in wartime.

If they WEREN'T doing this, then I'd be worried.

I think Japan is planning something...hold on, let me get a warrant so I can check it out...DOH!
